Notice of Intent to Sole Source Solicitation Number: NICHD-23-030 INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institutes of Health (NIH), National Institute of Child Health and Human Development (NICHD), Office of Acquisitions (OA) intends to negotiate and award a contract without providing for full and open competition (Including brand-name) to: THE UNIVERSITY OF PITTSBURGH PHYSICIANS, INC. 3601 Fifth Ave. Pittsburgh, PA 15213 NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 621511 with a Size Standard $36.5M. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2021-05, March 10, 2021. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($250,000). FAR clause at 52.212-4, Contract Terms and Conditions � Commercial Items, applies to this acquisition. FAR clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders � Commercial Items, applies to this acquisition. STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. GENERAL INFORMATION 1. Title: Ovarian Tissue Cryopreservation Protocols Processing and Cryopreservation 2. Background Information: The Pediatric and Adolescent Gynecology (PAG) program has developed several protocols for ovarian tissue cryopreservation and evaluation: 1. A protocol in individuals with Turner Syndrome, individual with Turner syndrome with Y material who undergo prophylactic gonadectomy, galactosemia, postmenarcheal adolescents with recent premature ovarian insufficiency, and adolescents with diminished ovarian reserve (DOR) who have contraindication to ovarian stimulation as well as those with diminished ovarian reserve who did not respond to ovarian stimulation 2. Two protocols (One at NIH (protocol #000715-CH) and a second one at Children�s National (protocol #Pro00010699)) for tissue banking from individuals undergoing ovarian tissue cryopreservation prior to undergoing gonadotoxic therapy. In these protocols one ovary will be removed, 80% of the tissue will be stored for future use by the patient and 20% will be saved for research. 4. Period of Performance: Base Period: December 7, 2022 through December 6, 2023 Option Period 1: December 7, 2023 through December 6, 2024 Option Period 2: December 7, 2024 through December 6, 2025 Option Period 3: December 7, 2025 through December 6, 2026 Option Period 4 : December 7, 2026 through December 6, 2027 CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include a technical proposal, a cost-price proposal, the period of performance, the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by November 28, 2022, 09:00 AM Eastern time and must reference solicitation number NICHD-23-030.
