- Description
- The Department of Homeland Security (DHS), Office of Procurement Operations (OPO), Information Technology Acquisition Center (ITAC), Office of the Chief Information Officer, (OCIO), Solutions Development Directorate (SDD), Research Library and Information Services (RLIS) intends to award a sole source purchase order to National Fire Protection Association (NFPA), Inc, 1 Batterymarch Park STE BSMT, Quincy, MA 02169 for the renewal of the National Fire Codes All Access Subscription Service. This solicitation document and incorporated provisions and clauses in effect through Federal Acquisition Circular (FAR) 2022-08, the North American Industry Classification System (NAISC) is 511120 with a business size standard of 1,000 employees. A quote is being requested under solicitation no. 70RTAC23Q00000014 using Simplified Acquisition procedures. This will be a fixed price contract for 12 months. Based on DHS market research, it has been determined that NFPA is the only source to meet DHS requirement and no other supplies or services will satisfy the agency requirements. NFPA Data Base is owned and copyrighted by NFPA and is protected by U.S. copyright law and international treaty provisions. The proposed contract action is for the renewal of the National Fire Codes All Access Subscription Service which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.106-1(b)(1)(i). �This notice is not a request for competitive proposals. �The following clauses and provisions are incorporated by reference and apply to the acquisition: FAR 52.212-1, Instructions to offeror-Commercial items (NOV 2021); FAR clause 52.212.-2, Evaluation Commercial item (NOV 2021); FAR clause 52.212-4 Contract Terms and Conditions items (NOV 2021); FAR 52.212-5 clause, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercials items (OCT 2022). Offeror shall include a complete copy of the clause 52.212-3 Offeror Representations and Certifications � Commercial item (OCT 2022). �The full text of clauses can be obtained at Web Site https://www.acquisition.gov/browse/indes/far. A determination by the Government not to compete this proposed requirement is based upon responses to this notice and is solely within the discretion of the Government.
