Please let me know if you need my help. Hai-En From: Mezzetta, Ed Date: Thursday, January 19, 2023 at 10:19 AM To: Tsai, Hai-En Subject: RE: BAA-SmarAct -Req#335144 Good afternoon, The main problem with SmarAct is that it is not made in the US, and it has no competition, so I cant solicit other companies. By placing this on SAM for 14 days it provides evidence that we tried. Over $25,000, there needs to be competition. Let me know if you are ok to proceed this way? Best Regards, Ed Mezzetta Procurement Commodities Team SLAC National Accelerator Laboratory 2575 Sand Hill Road Menlo Park, CA 94025 From: Tsai, Hai-En Sent: Wednesday, January 18, 2023 5:53 PM To: Mezzetta, Ed Subject: Re: BAA-SmarAct -Req#335144 Hi Ed, Thank you for your reply. My answers for BAA are in red as follow: 1. Is this requirement for a replacement or spare? A replacement and, an extension of an existing system. 2. Is this a commercial product with software or information technology? A commercial product. We use SLAC developed software to control it. 3. Will product be connected to a computer, network storage, or other existing systems? It will be connected to the network server. 4. Will product be used to collect, extract, and/or exchange data? No, it is to control the motion. 5. Is this a Commercial Off the Shelf (COTS) item that is assembled in the US? Yes. I have never done FBO. I know that many different teams in LCLS are using the same SmarAct control system. Its just to be consistent and avoid causing new issues. Can I just reference their procurement? Best. Hai-En From: Mezzetta, Ed Date: Wednesday, January 18, 2023 at 1:53 PM To: Tsai, Hai-En Subject: BAA-SmarAct -Req#335144 Good afternoon, Buy American Act (BAA) will need to be satisfied for Requisition # 335144 due to the requested price being over $10,000. Kindly Provide your response to my questions below to help me determine if BAA can be exempt. 1. Is this requirement for a replacement or spare? 2. Is this a commercial product with software or information technology? 3. Will product be connected to a computer, network storage, or other existing systems? 4. Will product be used to collect, extract, and/or exchange data? 5. Is this a Commercial Off the Shelf (COTS) item that is assembled in the US? Please take note if it does not, I will post for 15 days in FBO. In Addition, since this is over $25K, it would be best for procurement to compete this to justify the price. Could you please provide the following? Advise a list of other vendors that I can compete this with.- if none, then may post in FBO to look for competition. Specific description of the item you need. Specifications for the item. I will use the specifications that you provide as technical evaluation criteria in A7 Source Selection Plan. I have started the Source Selection Plan and highlighted in yellow what would need to be filled out for technical evaluation. I have attached examples. While SmarAct does not have competition it will need to be post on SAM to look for some. Let me know if you need any more information. Best Regards, Ed Mezzetta Procurement Commodities Team SLAC National Accelerator Laboratory 2575 Sand Hill Road Menlo Park, CA 94025
