Description
The Federal Maritime Commission, Office of Human Resources (OHR) has a requirement for Crucial Conversations training with VitalSmarts/Crucial Learning. The Federal Maritime Commission intends to issue a sole source contract to Crucial Learning: 320 River Park DR STE Swb Provo, Utah 84604-6060 under the authority of FAR 6.302-1(b)(2) due to �the existence of limited rights in data, patent rights, copyrights, or secret processes.� It has been determined that Crucial Learning is the sole owner of the intellectual property assets in the form of training programs and all associated materials. Crucial Learning is uniquely qualified given that all materials and facilitation pertaining to these programs are copyrighted and registered and are not distributed through or provided by any other individual or company other than Crucial Learning. Furthermore, Crucial Learning owns all rights to grant licenses for use of its intellectual property. The Federal Maritime Commission will procure the training to teach FMC employees the skills they need to have crucial conversations to deal with difficult subjects in emotionally charged environments. The training is used to help employees improve their overall communication skills. Performance will take place virtually at the Federal Maritime Commission government office. The Government intends to acquire commercial items and services using the provisions, clauses and procedures prescribed in FAR Part 13. The NAICS Code for this procurement is 611430. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact no later than 10:00 a.m. Eastern Time on 5/31/2023. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice.
