Single Source Justification for SAP under the SAT Page 1 of 1 DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: 36C262-23-AP-6604 Contracting Activity: Department of Veterans Affairs, VISN 22, Network Contracting Office-22, Greater Los Angeles VA Healthcare System, West Los Angeles VA Medical Center and VA Sepulved Medical Center. 2237#: 691-23-3-5042-0615 Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The purpose of this acquisition is to procure administrative support services via Pacific Coast Contracting Group (PCCG) to compile, calculate, draft, register, and maintain applications, reports, plans, and permits, as well as pay associated fees related to the South Coast Air Quality Management District or Environmental Protection Agency on behalf of the Department of Veterans Affairs, Greater Los Angeles VA Healthcare System, West Los Angeles Medical Center and VA Sepulveda Medical Center. The following applications, registration, reports, plans, and permits include: 1. South Coast Air Quality Management District Annual Emissions Reports a. The SCAQMD Annual Emissions reports are comprehensive documents that provide detailed information about the sources and quantities of air pollutants emitted into the atmosphere within the agency's jurisdiction. 2. Hazardous Material Business Plans (HMBPs) a. Hazardous Material Business Plans (HMBPs) are documents required by the California Health and Safety Code, specifically the California Code of Regulations, Title 19, Division 2, Chapter 4.5, sections 25500-25520. The purpose of HMBPs is to provide emergency responders, regulatory agencies, and the public with important information about facilities that handle hazardous materials. These plans are intended to ensure that businesses are adequately prepared for emergencies involving hazardous materials and to protect public health and the environment. 3. Mandatory Reporting Rule for Greenhouse Gas Emissions (Report) a. The United States Environmental Protection Agency (EPA) requires the mandatory reporting of Greenhouse Gases Rules, found in 40 CFR part 98. Requiring certain industrial facilities within the United States to collect and report data on their emissions of greenhouse gases annually. 4. South Coast Air Quality Management District - Shooting Range Permit 5. South Coast Air Quality Management District - Application to modify the continuous Emissions Monitoring System at the West Los Angeles VA Medical Center 6. South Coast Air Quality Management District Rule 1415 Registration a. South Coast Air Quality Management District (SCAQMD) Rule 1415 refers to the Registration of Toxic Air Contaminant (TAC) Emissions. This rule is a part of the SCAQMD's efforts to monitor and regulate emissions of toxic air contaminants in the Southern California region to protect public health and air quality. b. Rule 1415 requires certain facilities that emit toxic air contaminants above specified thresholds to register with the SCAQMD. The rule aims to identify sources of toxic air pollutants and assess their potential impact on public health and the environment. The estimated amount of this contract is: $55,250.00 Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Pursuant to 38 U.S.C 8127(b) and in accordance with VA Acquisition Regulation (VAAR) 819.7008, Contracting officers may utilize other than full and open competition to award a contract to a certified service-disabled veteran owned small businesses for procurement under the Simplified Acquisition Threshold. Pacific Coast Contracting Group (PCCG) has a proven track record of delivering satisfactory services to various government agencies, including the Department of Veterans Affairs, thereby attesting to their capability in successfully executing tasks. Their satisfactory past performance serves as a reliable indicator of their ability to maintain the highest standards of service delivery, compliance, and accuracy. PCCG's status as a certified Service Disabled Veteran Owned Small Business within the Small Business Asssociation Veteran Small Business Certification program, further bolsters their suitability for this endeavor. Aligning with the Department of Veterans Affairs' commitment to supporting veteran-owned businesses and fulfilling socio-economic objectives while providing satisfactory services. Description of market research conducted and results or statement why it was not conducted: Market research was conducted via multiple methods to include, reviewing the VA s VetCert database, reviewing recent market research undertaken to meet similar or identical requirements. querying Government-wide databases, review of market pricing, and other market research methods. FPDS.gov was queried utilizing, SCAQMD Reports and found two (2) similar requirements pertaining to SCAQMD administrative services. 36C26223P1701 36C26223C0027 CPARS was queried to determine past performance responsibility of Pacific Coast Contracting Group, SAM UEI: : EG15L8DBNR78. A CPARS assessment report was pulled for Pacific Coast Contracting Group. Past performance data revealed satisfactory to exceptional performance throughout all records input into the system. VetCert s NAICS code search function was utilized with 541620 . Search results revealed there are 1020 capable SDVOSBs and VOSBs registered under NAICS 541620. Additionally, VetCert was utilized to identify the validity of Pacific Coast Contracting Group status as a Service-Disabled Veteran Owned Small Business. Their status was verified as an SDVOSB. Recent market research results were reviewed to meet similar identical requirements. The following market research results were reviewed from the two contracts identified utilizing FPDS.gov: 36C26223P1701 This requirement was for a one-time purchase order for services to comply with South Coast Air Quality Management District Rule 2022, Emission Credit transfer and Rideshare Matching database. Market research report stated that the State of California informed the Loma Linda VA Medical Center that they needed to be in compliance with the South Coast Air Quality Management District Rule, 2202 Emission Credit Transfer and Rideshare Matching Database by the end of June 2023. Because of the condensed timeframe, the normal procurement processes could not be utilized. The facility researched the marketplace and was able to find RideLinks, Inc., a woman-owned small business concern. RideLinks provided similar services to the Medical Center in the past and was determined capable to provide these unique services. 36C26223C0027 This requirement was for a Base Plus Four (4) Option Year contract to provide Regulatory Fund SCAQMD Rule 2202 Services for the Loma Linda VA Medical Center. Market research report stated queries of the defunct Vendor Information Page (VIP) resulted in zero (0) results for SDVOSBs under NAICS 541620 Environmental Consulting Services. A sources sought (36C26219Q0051) was posted to FedBizOpps (FBO) and returned one (1) response from a Small Business vendor Ridelinks, Inc. Market research supported the requirement to be competed via Open Market Small Business Set-Aside. The Greater Los Angeles VA Healthcare System facility found an SDVOSB vendor Pacific Coast Contracting Group (PCCG) willing to provide administrative services related to the South Coast Air Quality Management District (SCAQMD) and Environmental Protection Agency (EPA) applications, reports, plans, and permits. The facility requested an informal quote from PCCG to perform services in accordance with the statement of work. The vendor provided a quote to perform services dated 5/6/2023, valid for ninety (90) days in the amount of $55,250.00. A search was conducted on FPDS using SCAQMD Reports to determine a fair market price of similar requirements and previous acquisitions. The search revealed 2 contracts (within the last 5 years) previously awarded for these types of services. The average action obligation is $97,583.30. The estimated contract value of $55,250.00 would be considered fair and reasonable according to past procurement market pricing. The Department of Veterans Affairs holds the unique capability to award contracts to verified service-disabled veteran owned small businesses pursuant to 38 U.S.C. 8127(b) and VA Acquisition Regulation 819.7008. Market research has proven that the commercial marketplace has now opened to service-disabled veteran owned small businesses that can perform environmental consulting services. The estimated contract value of $55,250.00 is within reasonable range considering past procurement history and market price. The service-disabled veteran owned small business that submitted an informal quote is considered responsible via contractor performance assessments. In accordance with FAR 13.106-1(b) and VAAR 819.7008, it is recommended that the Government proceeds with a sole source award to Pacific Coast Contracting Group. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
