- Pursuant to the Federal Acquisition Regulation (FAR) Subpart 8.405-6 and the Bureau of Prisons Acquisition Policy (BPAP) 6.304(a), the Federal Bureau of Prisons (BOP) has determined that restricting consideration of GSA/FSS schedule contractors is justified for this procurement action. Pursuant to FAR 8.405-6(a), the Contracting Officer is required to justify limiting the source when the order will exceed the micro purchase threshold. There are only instances whereby an order qualifies to be placed as a limited source. FAR 8.405-6(a)(l)(i)(B) cites one reason as, ""only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized."" The documentation to support this is as follows: The BOP, Office of Information Systems (OIS) has a requirement for O�Reilly Online Learning Library Services (FKA New Safari Library) which provides a digital library for information technology support staff by providing an online instruction intranet site for the use in maintaining, updating, and upgrading the BOP's internet and intranet. Technology support staff is then able to access learning resources as well as customize and organize the resources. Market Research was conducted to determine the availability of eligible contractors to provide the BOP's requirement under the FSS. It was determined that O�Reilly Online Learning Library Services (FKA New Safari Library) is proprietary to O'Reilly Media, Inc. and cannot be maintained or offered by another vendor unless approved by O�Reilly Media, Inc. Currently, O'Reilly Media, Inc. does not grant any other vendor reseller rights on GSA/FSS. As a result, the BOP can only acquire the premium library services through O�Reilly Media, Inc. The BOP has established use of this product and has invested a substantial amount of funds in procuring and maintaining this software. Therefore, it would not be cost effective to discontinue the use of this service. The estimated cost is not expected to exceed $37,106.00 for 100 users. The order will be established in accordance with the terms and conditions of the referenced GSA/FSS contract for which the GSA/FSS Contracting Officer has already determined the prices to be fair and reasonable. The Bureau contracting officer has determined the GSA FSS to be the best value for the government.
