Subject: SPECIAL NOTICE 36C24923Q0621 Description: NOTICE OF INTENT TO AWARD A SOLE SOURCE The Department of Veterans Affairs (VA), Network Contracting Office (NCO) 9, intends to issue a Firm Fixed Priced contract under the authority of Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), Soliciting from a single source. On or about September 18, 2023, an award is anticipated to occur to LRP Publications Inc. The period of performance will be for one calendar year after contract award. This requirement includes the purchase of Cyberfeds web subscription renewal for Veterans Integrated Service Network (VISN) 9 Human Resources (HR) managers and staff. LRP Publications Inc. is a leading publisher of legal and regulatory information for federal employment law and HR professionals. In addition to case law, regulations, forms, manuals, and handbooks, LRP's attorneys, former federal employment law experts, editors, and journalists provide guidance, interpretive analysis, and training not available from other sources. This is a sole source requirement because it is an exclusive web source for an instant searchable federal civil service law database. A search of the Federal Procurement Data System found 30 orders VA-wide for Cyberfed database subscriptions. LRP Publications Inc. was awarded all 30 of these orders. Since this is a sole source requirement, it is more advantageous to the Government to create a new contract to extend the Cyberfeds web subscription as all HR managers and staff throughout the VISN are familiar with and use this service routinely. The contractor will be responsible for providing access to the web subscription to VISN 9 in a timely manner. NCO 9 intends to non-competitively award this requirement to LRP Publications Inc. since they are the sole producer and source for the copyrighted Cyberfeds database web subscription. Furthermore, no similar database web subscriptions were found during market research for sale to be utilized at VISN 9 facilities. As a result, any contractor other than LRP Publications Inc. that would provide a web subscription to the facility would unintentionally cause a delay in VISN 9 business operation. Unnecessary delays cannot be endured. The North American Industry Classification System (NAICS) code for this requirement is 519290, with a size standard of 1,000. The applicable Product Service Code is 7H20. This notice of intent is not a request for proposals or quotes. However, all responsible service-disabled veteran-owned small businesses and veteran-owned small businesses may submit an offer and technical capabilities/narrative that proves by clear and convincing evidence that a similar database web subscription is available that will provide comparable database abilities for the VISN. If said OFFER and technical capabilities/narrative is received within three calendar days of publication of this notice, the narrative will be considered by NCO 9. All responses must be submitted to the Government point of contact at the email address shown below. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government. Information received will generally be considered solely for the purpose of determining whether to conduct a competitive procurement.
