INTENT TO SOLE SOURCE: ANNUAL PM & SERVICE AGREEMENT FOR MAR COR CWP 100 H/S REVERSE OSMOSIS (RO) HIGH QUALITY WATER PURIFICATION SYSTEM THIS IS NOTICE OF INTENT TO SOLE SOURCE MAR COR CWP 100 H/S RO HIGH QUALITY WATER PURIFICATION SYSTEM: VAMC JAMAICA PLAIN MA. INTENT TO SOLE SOURCE FOR PURCHASE REQUISITION: 523-24-1-7441-0008: This is not a request for competitive proposals. This is not a solicitation or request for offers. No solicitation package is available and telephone requests will not be honored. The Department of Veterans Affairs VA Medical Center intends to award a one-year, Firm Fixed Price, Sole Source contract for Annual/Periodic Service and Maintenance for the MAR COR CWP 100 H/S RO Water Treatment System located in the Dialysis Clinic at VAMC Jamaica Plain MA, to the large business (LB) OEM (Original Equipment Manufacturer) MAR COR Purification Inc. Proprietary knowledge, technical expertise, and servicing capabilities are proprietary and peculiar to MAR COR. The proposed period of performance will be 10/04/23 10/03/24. The required annual/periodic servicing and disinfection for MAR COR Brand RO Water Treatment Systems is proprietary to MAR COR. MAR COR is the manufacturer and the sole source provider of the Annual Maintenance Services for MAR COR Reverse Osmosis (RO) Water Treatment Systems. The MAR COR Water Treatment Systems being serviced have an FDA 51 0(k) clearance. These RO Water Treatment Systems are exclusively designed to provide hemodialysis water quality that meets ANSI/AAMI standards. Annual RO PM and service, and any affiliated disinfection services need to be performed in accordance with the Joint Commission (TJC) and Association for the Advancement of Medical Instrumentation (AAMI) requirements. MAR COR as the OEM is the only capable service provider, they are unique in their capability to service the CWP 100 H/S RO Water Purification Equipment. A Sole Source Letter has been provided by the OEM describing the proprietary nature of the MAR COR RO Water Treatment Systems. The letter states that only the OEM can service, maintain, and provide the annual and periodic servicing required for the MAR COR RO Water Treatment Systems. No other vendors in any class are authorized by the OEM to perform these services. A VA Memorandum requires the use of MAR COR for the procurement of RO Water Treatment Systems and the affiliated maintenance and services, which also includes disinfection. The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901. This statute is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(2). The intent is to procure these services on a sole source basis. No solicitation will be posted to Contract Opportunities. The primary North American Classification System Code (NAICS) is 811210 Other Electronic and Precision Equipment Repair and Maintenance. The most current Business Size Rating for this NAICS is $34M. Capable parties may identify their interests and authorization to respond to this requirement by September 25th, 2023, at 10:00 (EDT). A determination by the Government not to compete this proposed award upon response to this notice is solely within the discretion of the Contracting Officer. STATEMENT OF WORK Preventative Maintenance of Jamaica Dialysis Water Purification System EE# 183775, Serial # 1363885, Reverse Osmosis System MAR COR 523-24-1-7441-0008 REQUESTING SERVICE: BHS Clinical Engineering Jamaica Plains, MA INTRODUCTION: The purpose of this service contract is to provide periodic disinfection services for the Reverse Osmosis (RO) water system at the VA Jamaica Plain Medical Center. Hemodialysis requires specific water purity, characteristics, and testing to be approved for clinical use on patients per the Joint Commission (TJC) requirements and AAMI standards. Part of this testing involves periodic disinfection of the RO water system to ensure that there is no bacterial growth within the water supply system. VA Boston currently does not possess the knowledge and expertise of this disinfection process and is soliciting the services of MARCOR Inc. to provide the on-site disinfection and preventive maintenance services. SECURITY REQUIREMENT All contractor personnel shall report and obtain a short-term identification badge issued by the COR or government designated representative. Such badge shall be worn by the individual and prominently displayed-at- all times while on VA Property. No employee of the contractor shall enter the site without a valid identification badge issued by the VA. To obtain a short-term identification badge, contractor personnel shall present to the COR a valid (non-expired) photo identification issued by a US federal, state, or local government agency. After hours all contractor personnel (without exception) must report to the Clinical Engineering Department, to sign in where a contractor identification badge is verified before any work is performed. Contractor personnel will be escorted by Clinical Engineering staff for the duration of work performed and return to the same location to sign out and turn-in documented service report for the service performed. BACKGROUND: The hemodialysis clinic at the VA Jamaica Plain Medical Center offers dialysis services to veterans to provide a better standard of life for those with renal failure. The fundamental medical system used for this treatment is the dialysis machine, which requires purified water from a RO treatment system to function safely. Likewise, to maintain the purification of the water purification system and loop, periodic disinfection of the system is required to ensure that there is no bacterial growth within the water supply system. The services for performing this disinfection process are being obtained through this procurement package. SCOPE OF WORK & REQUIREMENTS This service contract to maintain the BHS Jamaica Plain Dialysis Water System should contain the following components at a minimum: 1. The contractor must have service personal with manufacturer trained experience and expertise on the equipment identified 2. The contractor must perform preventative maintenance on the Dialysis Water System monthly, quarterly, and annually. This work will require the vendor to do the work at the Jamaica Plain campus, 150 S Huntington Ave, Boston MA 02130. 3. The preventative maintenance should cover all steps and line items in the chart found in the appendix. 4. The contractor must provide a report of service summary for any work performed to the clinical engineering point of contact. 5. No parts should be ordered without prior confirmation from the clinical engineering service. 6. Clinical engineering will require at least an annual meeting to review contract performance, equipment changes and provide support feedback.
