Description
The United States Section of the International Boundary and Water Commission (USIBWC) is issuing a Solicitation (negotiated) for design and construction for the South Bay International Wastewater Treatment Plant (SBIWTP) Rehabilitation and Expansion project.� This requirement is being procured as full and open competition. The proposed contracting method will allow for a collaborative approach to develop a project that includes essential rehabilitation of existing infrastructure and ultimately expand the capacity of the plant to treat an average daily flow of 50 MGD with a with a peak hydraulic flow, peak hour, capacity of 75 MGD. The SBIWTP is located immediately north of the United States and Mexico border in San Diego County, California in the City of San Ysidro. The plant is situated nearly two (2) miles west of the San Ysidro International Port of Entry. The SBIWTP treats an average daily flow of 25 MGD of raw sewage originating from Tijuana, Baja California, Mexico under a binational agreement between the United States and Mexico. The SBIWTP treats to secondary treatment standards per California discharge requirements under the National Pollutant Discharge Elimination System (NPDES) permit issued to USIBWC. The SBIWTP facility includes canyon collectors, pumping plants, headworks, primary clarifiers, activated sludge tanks, secondary clarifiers, and solids handling via thickening, dewatering, and lime stabilization that is transported for disposal in Mexico. The SBIWTP discharges the secondary effluent approximately 3.5 miles off the coast into the Pacific Ocean through the South Bay Land and Ocean Outfalls. The Environmental Protection Agency (EPA), in partnership with the USIBWC and Mexico, continues to address the urgent need to substantially reduce cross-border sewage flows. In 2020, Congress appropriated funding through the U.S.-Mexico-Canada Agreement (USMCA) implementing legislation directing EPA to plan, design, and construct infrastructure to address the above problems. In 2021, EPA developed a package of projects in the U.S. and Mexico for a long-term solution in coordination with federal, state, and local agencies and the public. In 2022, the U.S. and Mexico governments signed a binational agreement known as IBWC Minute No. 328 and agreed to implement the solution to expand the SBIWTP to 50 MGD to alleviate the discharge of wastewater into the South Bay (Pacific Ocean). This project aims to reduce transboundary flows from Tijuana that cause adverse and disproportionate public health and environmental impacts in the Tijuana River watershed and adjacent coastal areas. The proposed project design includes essential rehabilitation and expansion to reach a treatment capacity of 50 MGD average daily flow with a peak hydraulic flow, peak hour, capacity of 75 MGD. It is anticipated that in order to meet the project goals, construction will be phased. Design packages shall be prepared for the base construction and phased construction packages for the full expansion. For construction, the base project includes rehabilitation and expansion to a treatment capacity of an average daily flow of 45 MGD with no peaking factor. Based on available funding, additional phased construction efforts would increase the capacity an additional 5 MGD to 50 MGD average daily flow with no peaking factor, and then increase the peak hydraulic flow capacity to 75 MGD. Construction packages are intended to be issued concurrent with design to start construction early. The SBIWTP is constrained and fenced. Access to the site is controlled by private onsite security administered by USIBWC and plant Operations and Maintenance Contractor (O&M), Veolia North America (Veolia). Coordination with these entities will be required for site access. USIBWC employees and the Veolia employees are present continually for operation of the plant. US Customs and Border Patrol are also present at the site and the plant is regularly monitored by agents. Government operations will not cease during design and construction; the Design-Builder must schedule operations and coordinate all work to ensure access by Government agencies and O&M Contractor personnel at all times. Additionally, Veolia and its subcontractors may be performing construction rehabilitation work at the plant concurrently with this Contract. USACE also has a nearby construction contract for a barrier across the Tijuana River. No conflicts are expected with these other Contracts due to different areas of work within and outside the SBIWTP facility. However, coordination with other Contractors will be required as necessary. The estimated magnitude of the project is greater than $250,000,000. The project scope will include optional construction work that may be phased for award based on available funding. Items under this acquisition are subject to the Davis Bacon, Build America, Buy America (BABA) Act, the World Trade Organization Government Procurement Agreement, and Free Trade Agreements. A site visit date will be listed in the Solicitation. �The North American Industry Classification System (NAICS) code for this procurement is 237110 (Construction of water and sewer lines, mains, pumping stations, treatment plants, and storage tanks), a small business size standard of $35M. Construction is expected to start within one year of the contract award and take a minimum of three years. The final design and construction Contract schedule and durations will be negotiated with Offerors during the Phase Two technical proposal evaluations. USIBWC is procuring this requirement using the Progressive Design Build (PDB) approach with a deviation under FAR 1.400 and 52.216-17. The Solicitation will be issued pursuant to FAR Subpart 36.3 - Two-Phase Design-Build Selection Procedures. �Phase One shall include evaluation of technical qualifications and capability to perform. Phase Two shall include evaluation of technical proposal and price. The Solicitation is expected to be posted on or about November 27, 2023 (this is a target date and is subject to change). �The Solicitation for Phase One will be available for a minimum of forty five (45) calendar days. This is a Presolicitation Notice. This is NOT a request for offers or proposals.� Please do not submit a proposal in response to this Presolicitation Notice. �The Solicitation will include information on how to obtain the Scope of Work and attachments. �All responsible sources may submit a proposal to be considered by the Agency.
