- NOTICE OF INTENT TO NEGOTIATE A SINGLE-SOURCE CONTRACT In compliance with FAR Subpart 13 coupled with the provisions set forth by FAR Subpart 5.101(a)(1), this Notice is hereby published to inform of the following:The U.S. Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), Office of Management and Budget (OMB) intends to negotiate, on a sole source basis, under the authority of FAR 13.106-1(b)(1), with Thermo Electron North America LLC Using the procedures of FAR Part 13 the requirement is to procure the following: The contracted company will provide all equipment, personnel, tools, material, travel, supervision, and other items incidental to performing any service(s) necessary for repairs and maintenance to maintain the Thermo Scientific ICP Mass Spectrometer RQ (ICP-MS RQ), rough pump & power conditioner within design parameters, as described by the manufacturer�s maintenance manuals and technical bulletins and in accordance with the Statement of Work (SOW). The applicable Size Standard is North American Industry Classification System (NAICS) Code 811210 with a Small business size standard of $34M. This Sole Source Determination is based on NOAAA's requirement that Thermo Electon is the only Vendor that provides the required services.� The National Seafood Inspection Laboratory (NSIL) has analytical services for various stakeholders that include testing for heavy metal contaminants in seafood. This requires an Inductively-Coupled Plasma Mass Spectrometer, rough pump, and power conditioner, previously purchased from Thermo Scientific and currently located in lab 270. This equipment is highly sensitive to environmental conditions and external stimuli and requires a very specific understanding of how it performs and is to be maintained.� Task 1: The contractor will perform unlimited on-site repair visits including travel, labor, and genuine Thermo Scientific or Thermo Scientific-certified parts and consumables required for repairs as well as digital documentation of work performed on the ICP-MS RQ, rough pump & power conditioner. If repair is unable to be performed, exact replacement units shall be provided at no extra cost. The service report will be emailed to the end user & the Project Lead at the completion of the visit. Task 2: The contractor will provide annual on-site preventative maintenance (PM) including travel, labor, and genuine Thermo Scientific or Thermo Scientific-certified parts and consumables required for service as well as a digital report documenting successful completion of the PM and calibration performed on the ICP-MS RQ, rough pump & power conditioner. The service report will be emailed to the end user & the Project Lead at the completion of the visit. Annual visits will occur within 1 month of the date of the signing of the government purchase order (ex. Purchase order signed 2/20/24, annual PM occurs by or before 3/20/24). Task 3: The contractor will provide remote diagnostics and reporting when required on the Thermo Scientific ICP Mass Spectrometer RQ, rough pump & power conditioner, by phone or email, to the end user, when contacted or needed. Task 4: The contractor will provide �Premier Plan� response as well as telephone hardware and software support on the Thermo Scientific ICP Mass Spectrometer RQ, rough pump & power conditioner, to the end user, when contacted or needed. Period of performance is Date of Award through 3 years. This service will be performed at the National Seafood Inspection Laboratory at 3209 Frederic St., Pascagoula, MS 39567 **THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS AND NO SOLICITATION PACKAGE IS AVAILABLE. HOWEVER, FIRMS THAT BELIEVE THEY CAN FULLY MEET THE GOVERNMENT'S REQUIREMENTS MAY SUBMIT SUBSTANTIATING DOCUMENTATION IN WRITING TO THE IDENTIFIED POINT OF CONTACT WITHIN 15 DAYS AFTER PUBLICATION OF THIS SYNOPSIS. SUCH DOCUMENTATION WILL BE EVALUATED SOLELY FOR THE PURPOSE OF DETERMINING WHETHER OR NOT TO CONDUCT THIS PROCUREMENT ON A COMPETITIVE BASIS. A DETERMINATION BY THE GOVERNMENT NOT TO CONDUCT A COMPETITIVE PROCUREMENT, BASED UPON RESPONSES TO THIS NOTICE, IS SOLELY WITHIN THE DISCRETION OF THE GOVERNMENT.
