NOTICE OF INTENT TO SOLE SOURCE Contracting Opportunities Announcement Type: Special Notice Announcement Number: AMDTCNOI2401517 Title: NCST Investigation Support Services of the Champlain Towers South Partial Collapse Introduction This is a notice of intent, not a request for a quotation. A solicitation document will not be issued, and quotations will not be requested. Purpose The National Institute of Standards and Technology (NIST) intends to negotiate a firm-fixed priced purchase order on a sole source basis with J.R. Harris and Company, located at 1775 N. Sherman Street, Denver, CO, 80203. The purchase order will specifically procure contractor services to support the National Construction Safety Team (NCST) team in assessing the history of the Champlain Towers South building by providing technical input in understanding the building�s design, construction, permitting, code adherence, site conditions, and renovations and maintenance, and in developing and evaluating failure hypotheses. The period of performance will be effective from September 3, 2024, through September 2, 2025, with optional tasks that may extend the performance period by up to an additional five (5) months for a total performance period of 17 months. Authority This acquisition is being conducted under the authority of FAR Subpart 13.106(b)(1) allowing the Contracting Officer (CO) to solicit from one source. The North American Industry Classification System (NAICS) code for this acquisition is 541690 � Other Scientific and Technical Consulting Services, with a small business size standard of $19.0 million. Description Please see the attached Performance Work Statement (PWS) for additional detail. Sole Source Determination The sole source determination is based on the following: The National Institute of Standards and Technology (NIST) Engineering Laboratory (EL), under the authority of the National Construction Safety Team Act (NCSTA), is conducting an investigation of the June 24, 2021, partial collapse of the Champlain Towers South (CTS) condominium building in Surfside, FL � one of the worst life-taking structural disasters in US history. Under the National Construction Safety Team Act (Public Law 107-231, codified at 15 U.S.C. 7301 et. seq.) the NCST Investigation Team is required to be composed of individuals selected/appointed by the NIST Director and led by an individual appointed by the NIST Director. The NIST Director appointed Dr. James Harris, of J.R. Harris and Company, to the NIST Investigative Team of the Champlain Towers South (CTS) National Construction and Safety Team (NCST) Investigation, contained at the following link: https://www.nist.gov/disaster-failure-studies/champlain-towers-south-collapse-ncst-investigation/national-construction. For purposes of continuity of science, J.R. Harris and Company, is the only source that can fully achieve this requirement and the required services must be purchased directly through J.R. Harris and Company. No other sources exist that can achieve this requirement. Information for Interested Parties Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing by or before the response date for this notice.
