- NOTICE OF INTENT TO SOLE SOURCE The United States Department of Transportation, Federal Railroad Administration (FRA), intends to award a task order on a sole source basis to Sharma & Associates, Inc., to continue providing development and updates to the Train Energy and Dynamics Simulator tool (TEDS). And to help support industry when needed by utilizing TEDS for further understanding of events and for research.�� The work will include the continued development of the TEDS tool to incorporate data from real world train design operations. Additionally, support will continue for conducting research and studies of the performance of trains under different operational scenarios, and the incorporation of new technologies and operating practices of US railroads. TEDS provides the FRA with capabilities to analyze train dynamics considerations in detail and thus support the development/evaluation of safety rules and guidelines for improving railroad operational safety, for conducting analyses and investigations of railroad incidents, and for evaluating train performance and safety under a variety of critical conditions. Such simulation capabilities offer invaluable opportunities to FRA and others for conducting safety and risk evaluations, incident investigations, train operation studies, energy consumption studies, and evaluations of both new and current equipment. The statutory authority permitting other than full and open competition of these services is contained in 41 U.S.C. � 253(c)(1) as implemented by Federal Acquisition Regulation (FAR) 8.405-6 (a)(1)(B), ""Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized"".� The current contractor, Sharma & Associates, Inc., has successfully developed the source code and maintained the TEDS tool since inception.� The tool is unique in that it and its features are available industry-wide, including to non-railroad users, for conducting simulations of train on-track operations and equipment performance. Sharma & Associates owns the tool and the FRA has rights to use it.� RFI via GSA�s Market Research as A Service was issued on Feb 1, 2023.� The Streamlined Market Research and Acquisition Plan documented that there was only one response to the issued RFI by GSA and that vendor was determined not capable.���To date, no other qualified sources have expressed an interest, in writing, in the proposed acquisition.� This synopsis is not a request for competitive proposals; however interested parties may identify their interest and capability to respond to the requirement. Respondents must provide a capability statement.� Oral communications are not acceptable in response to this synopsis. Interested parties with the capability of meeting the proposed requirements are requested to identify their interest by email to the FRA point of contact, Luis.frontera@dot.gov �no later than 2:00 p.m. Eastern Time, Tuesday, Jun 25, 2024. Such capabilities/qualifications will be evaluated solely to determine whether to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the Government.
