- THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Office of intends to award a sole source contract under the authority of Federal Acquisition Regulation (FAR) Subpart 13.106-1 (b) Soliciting from a single source. For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. This contract(s) will be awarded to 10x Genomics, Inc. 6230 Stoneridge Mall Road, Pleasanton, California, 94588-3260 for the purchase of 10X Multiple kits. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 334516 with a Size Standard of 1,000. REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures. Contracts awarded using FAR Part 13�Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6�Competition Requirements. FAR Subpart 13.106-1 (b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2024-06 dated July 30, 2024. DESCRIPTION OF REQUIREMENT PURPOSE AND OBJECTIVES: The Neurophysiology of Epilepsy Unit in the National Institute of Neurological Disorders and Stroke (NINDS) is a part of the National Institutes of Health (NIH), conducting research into the causes and subsequent treatments of Drug Resistant Focal Epilepsy. The 10X Genomics reagents and supplemental kits requested will aide in unveiling specific genetic changes and mechanisms that may lead to increased and more severe seizures in chronic epileptic patients. These 10X Genomics sequencing reagents are needed as part of a large-scale single cell RNA sequencing study to understand the genetic expression profiles of tissues taken from epileptic patients. The purpose of the materials requested is to generate expression libraries and sequencing of cortex tissue taken from epileptic zones in patients with Drug Resistant Focal Epilepsy and then perform subsequent differential gene expression analysis to understand possible changes between normal and diseased tissue expression profiles. 10X Genomics is the only company manufacturing the Chromium Nuclei Isolation with RNase Inhibitor Kit (16rxns), Chromium Next GEM Chip J Single Cell Kit (48 rxns), Chromium Next GEM Single Cell Multiome ATAC + Gene Expression Reagent Bundle (16 rxns), compatible with the 10X genomics chromium controller, proprietary sequencing machine utilized by the NIH for sequencing ,and are all needed to generate the expression profiles of the tissues taken and for the subsequent expression analysis. SCOPE OF WORK 10X Chromium Next GEM Kits. The shelf life for kits are 3 to 12 months, entire kits are planned to be used in 6 months as samples are ready to be processed. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. The essential characteristics of the kits limit the availability to a Brand Name Only. The Chromium Nuclei Isolation with RNase Inhibitor Kit (16rxns), Chromium Next GEM Chip J Single Cell Kit (48 rxns), Chromium Next GEM Single Cell Multiome ATAC + Gene Expression Reagent Bundle (16 rxns) listed is available from only one source and there are no substitutes available. The intended source is: 10x Genomics, Inc. 6230 Stoneridge Mall Road Pleasanton, CA 94588 United States of America CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Unique Entity ID (UEI), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov.
