- LIMITED-SOURCES JUSTIFICATION (LSJ) FOR MULTIPLE-AWARD SCHEDULE PROGRAM Upon the basis of the following justification, prepared in accordance with Federal Acquisition Regulation (FAR) 8.405-6(c), I, as Contracting Officer, hereby approve the use of sources limited to fewer than those required in FAR 8.405-2, pursuant to the authority of 41 U.S. Code (USC) 251 as implemented by FAR 8.405-6(a)(1)(i)(C). This acquisition is conducted under the authority of the Multiple Award Schedule program (41 USC 251, et seq. and 40 USC 501). 1. Agency and Task Ordering Activity: Contracting Office: United States Environmental Protection Agency (EPA) Information Technology Acquisition Division (ITAD) 109 T.W Alexander Drive Mail Code: AA005 Research Triangle Park, NC 27711 Project Office: Office of the Chief Financial Officer (OCFO) Office of Technology (OTS) Ronald Reagan Building Washington, DC 20460 2. Nature/Description of Action(s): This limited source justification supports a task order award on a sole source basis to CFocus Software Incorporated (CFocus) under General Service Administration�s (GSA) Multiple Award Schedule (MAS) for SIN 54151S Information Technology Professional Services. The current task order, GS00Q17GWD2061/ 47QFLA19F0104 provides OCFO OTS IT Support Services expires on August 31, 2024, and requires additional time and effort for the transition of services, documentation, training, and system knowledge transfer to the new contractor. The follow-on award will be made prior to August 31, 2024. Proposed Contractor: Cfocus Software Inc. 10536 Joyceton Dr. Largo, MD 20774-1332 3. Description of Supplies/Services Required to meet the Agency�s needs: The Environmental Protection Agency (EPA) requires additional time and effort to transition to the task order award for OCFO OTS IT Support Services. This task order award to CFocus shall provide transition support from the current OCFO OTS IT Support Services task order to the EPA�s new task order contractor, in accordance with the task order PWS. The period of performance of this Task Order is as follows:� Base Period (45 Days) - September 01, 2024 � October 15, 2024 Option Period 1 (30 Days) - October 16, 2024 � November 15, 2024 The estimated value of this requirement is $ for the base period and option period, if exercised. 4. An identification of the LSJ rationale, and if applicable, a demonstration of the contractor�s unique qualifications to provide the required supply or service: In accordance with FAR 8.405-6(a)(1)(i)(C), in the interest of economy and efficiency, the new work is a logical follow-on to an original order, and the original order was placed in accordance with the applicable GSA ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures. CFocus has supported EPA�s OCFO OTS by providing IT Support Services under task order GS00Q17GWD2061/47QFLA19 F0104 since May 2019. Some of these services include support for critical updates to the EPA Unliquidated Obligations (ULO) System in response to corrective actions driven by a recent Office of Inspector General (OIG) audit of OCFO�s management of unliquidated obligations. Specifically, CFocus support is needed to transition implementation of automated notifications on aging unliquidated obligations and to implement updates to database forms and analytics in support of measures to address unliquidated obligations in a quarterly frequency across the entire fiscal year. Furthermore, OTS is responsible for hosting Business Objects for financial, grant and various other data. CFocus provides the System Administrator who oversees the management of this system. Without transition assistance there is a risk that the system administrator may not be able to maintain security, provide migrations, data backups, troubleshooting, and providing technical support to system developers and users. Transition services will prevent a possible break in services which could put the agency at risk for not being able to provide reports for the Fiscal Year End Process. Lastly, CFocus provides the System Administrator who oversees the management of the Enterprise Data Quality s (EDQ) system. This system is used for the Agency�s financial reporting mandated by the 2014 Digital Accountability and Transparency Act (DATA). If there is not an adequate transition of services to the new contractor of these legacy systems services, the Agency could be held liable for the delay in reporting the required information. The transfer of knowledge required to maintain this support during this transition period is extensive and will require a minimum of 45 days. 5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d): The anticipated cost to the Government is determined to be fair and reasonable by the Contracting Officer for this task order award. The Independent Government Cost Estimate (IGCE) not to exceed value for this award is $ . The proposed labor rates are in accordance with the terms and conditions of the current period of performance CFocus rates which were determined to be fair and reasonable at award.� 6. A description of the market research conducted among schedule holders and the results, or a statement why market research was not conducted. A statement must be made that the supplies and services are available from the MAS: Market research was not conducted due to the fact that no other contractor has the requisite working knowledge about each task that CFocus has acquired during the performance of the current task order with the EPA legacy systems. Awarding this short-term transition work to any other contractor would be an inefficient use of Government resources, leading to unacceptable delays and duplication of costs. No other contractor is in the position to begin performance in a timely manner to provide adequate transition services for this short period of performance. It is in the best interest of the government to award a task order on a sole source basis for transition services to avoid a lapse of these critical services until the contract transition of the services is complete. 7. Any other facts supporting the limited source justification: This task order award for transition services is needed due to the complexity of the work and no other contractor than the current contractor can effectively transfer the knowledge regarding the performance of the current services to the new contractor. Additionally, the current task order was competed on General Services Administration�s STARS 2 Government-wide acquisition contract as a competitive order and fair opportunity was given at the time of task order award. 8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made: The follow-on task order was competed as a Small Business 8(a) Certified set-aside on GSA MAS SIN 54151S Information Technology Professional Services. ITAD is finalizing award documentation, and the anticipated award date is prior to August 31, 2024. The purpose of awarding this follow on task order on a sole source basis is not to circumvent competition but, to allow for sufficient time to effectively transition the services to the new awardee of the followon task order in order to prevent any risk for service interruption of these critical systems. The new task order award will have transition planning provided in the last period of performance. 9.
