Basic Conditions of Participation: Applicants are allowed to participate in this procurement procedure by itself or jointly with other suppliers. In the case of joint participation, participants have to decide on a representative who will contact NTT at every stage, including application, selection and contract negotiations. Although NTT will contact and negotiate with the chosen representative, all joint participants shall assume every obligation and liability related to this procurement regardless of their status. However, suppliers who fall under any of the following conditions cannot participate in the procurement: (i) suppliers adjudicated to be an incompetent or quasiincompetent; (ii) suppliers adjudicated to be bankrupt, and who have not yet been reinstated; (iii) suppliers under arrangement, composition, corporate reorganization, bankruptcy or liquidation proceedings; (iv) suppliers who within the last two years, (a) wilfully did poor or faulty work in the manufacture of any products or in the performance of any services under a contract with NTT, or committed any unfair act with respect to the quality and/or quantity of any products supplied thereunder; (b) conspired with any other supplier or suppliers in application and/or tender or conclusion and/or performance of a contract with NTT with an intention to gain unfair profits; (c) interfered with any other tenderer participating in a tender or entering into or performing a contract with NTT; (d) interfered with any personnel of NTT in the performance of their duty, or refused or failed to cooperate with any personnel of NTT in the performance of their duty, at any inspection or supervision; (e) failed or refused to inter into any contract with NTT or to perform any contract with NTT without a just reason; (f) made any false report or misrepresentation in the procedures of application and/or tender or conclusion and/or performance of a contract with NTT; (g) committed any unfair act to interfere with any other supplier or suppliers in competition in NTT tenders; or (v) suppliers who are deemed to have gained unfair advantage in competition as a result of their direct involvement in the preparation of the final tender documentation and/or technical specifications for this tender.
