The U.S. Department of State, Office of Foreign Buildings Operations
(FBO) is seeking interested offerors for the construction of site
utilities and staff housing at the U.S. Embassy, Kuwait. The project
scope includes the following: new power distribution system, storm and
sanitary sewer system, dometic water distribution system and fire
hydrant distribution system, water irrigtion connection and storage
tank, roadways, sidewalks, site grading and thirty-tewo (32)
residential townhouse-type buildings of two and three tory height
ranging in size fro 173 gross square meters to 396 gross squar meters
or mansonry and concrete construction, a one-story multiple use
community center of approximately 300gross square meters and new
telephone and cable TV distribution system. The estimated value of
construction ranges from $5,000,000 to $10,000,000. The contract type
shall be a firm fixed price contract. The performance period is
estimated to be twenty-four (24) months from date of contract award.
The contractor is not required to have a security clearance for this
project. Public Law 69-186, Foreign Service Buildings Act, as amended,
22 USC 291-301 through 22 USC 291-302, applies to this acquisition.
This law limits competition to (1) American-owned bidders and (2)
bidders from countries which permit or agree to permit substanially
equal acess to American bidders fro comparable diplomatic and consular
building projects. To be qualified as an American-owned bidder, the
contracor must demonstrate evidence of (A) performance of similar
construction work in the United States, and (B) either (i) ownership in
excess of fifty percent by U.S. citzens or permanent residents or (ii)
incorpoation in the U.S. for more than three years and employment of
U.S. citzens or permanent redidents in more than half of the company's
permanent full time professionals and managerial positions in the U.S.
For purposes of determining competitive status, offers submitted by
American-owned firms shall be reduced by 10 per cetum, provided that
two prospective responsible bidders submit an offer. In order fro any
firm outside of Kuwait to do business in Kuwait, the firm must be
sponsored by a Kuwaiti agent in accordance with Kuwaiti law. Firms may
want to contact the Kuwait Embassy in Washington, D.C. for more
details. The U.S. Embassy cannot sponsor a firm. Local Kuwaiti firms
applying for this project must provide their Kuwaiti certification
and/or registration certifcate showing they have been qualified to do
this type of work in Kuwait. The solicitation package is planned to be
released in mid-July 1997. Cost of drawings and specifications will be
$300.00 per set, non-refundable. The drawings in the set wilol be
sepias. Plans and specifications will not be issued unitl receipt of
payment for the drawings and specifications and confirmation of
sponsorship for non-Juwaiti firms or certification/registration for
local Kuwaiti firms. Interested offerors shall provide a check in the
amount of $300.00 per solicitaition set, made out to the U.S.
Department of State and confirmation of Kuwaiti sponsorship and/or
