Engineers, St. Paul District, intends to negotiate with Wanzek
Construction Company, P.O. Box 2019, Fargo, North Dakota, on a
sole-source basis under the authority of 10 U.S.C. 2304(c)(2) as
implemented by FAR 6.302-2, Unusual and Compelling Urgency. To protect
the City of Devils Lake, North Dakota, against flooding, it is
necessary to raise the earthen levees and begin work on the replacement
of a 24,000 gpm capacity pump station this construction season. The
Government plans to accomplish this requirement as described below by
supplemental agreement(s) to an existing contract for the Devils Lake
Levee Raise Stage 1. The original contract consists of constructing or
raising approximately 2.8 miles of levee to elevation 1450 or 1448
(providing protection to elevation 1445 plus freeboard) and
modifications to the existing Creel Bay pump station and gatewell. It
is now necessary to raise the earthen levees along the same alignment,
from an elevation of 1448 or 1450 (depending on the area) to an
elevation of 1457 including placement of riprap and the replacement of
the 24,000 gpm capacity pump station. This notice of intent is for the
raise to elevation 1454 and the replacement of the pump station, which
is the portion most urgently needed. The remainder of work will then
be competitively bid. The short construction season in this northern
part of North Dakota does not allow for earthwork past early November.
Therefore, it has been determined that there is not enough time for a
new contract to be advertised, awarded, and a new contractor
mobilized. In addition, awarding one or more prime contracts for
segments of the work is impractical since the geography, topography,
and available road access make it unlikely that two or more contractors
could work in the project area without interfering in each others
operations. The work covered under this proposed modification will
include approximately 260,000 cyds of impervious fill and 60,000 cyds
of riprap. The proposed modification consists ofessentially the same
type of work and will require minimal modifications to the
specifications. The urgent nature of this requirement necessitates
designing the changes as the work progresses, therefore, no
solicitation document exists. No award will be made on offers/proposals
received in response to this notice. For subcontracting opportunities
