The Patent and Trademark Office intends to award a sole source contract in accordance with FAR 6.301-1 (Only one responsible source and no other supplies or services will satisfy agency requirements). Information Handling Services, 15 Inverness Way East, Englewood, Colorado 80112 is the only known source who can provide the required IEEE Electronic Library product/service utilized by the Patent and Trademark Office. The IEEE Electronic Library product/service is being procured for a twelve-month period with four (4) twelve-month option periods. This announcement constitutes the RFP and is the only solicitation that will be issued. This solicitation incorporates all of the applicable provisions and clauses in effect through FAC 97-10, as if stated in full text, as well as the terms and conditions of FAR 52.212-1. The proposal shall also include a completed copy of the provision at 52.212-3 entitled Offerors Representation and Certifications Commercial Items. The award shall include the clauses cited at FAR 52.212-4 entitled Contract Terms and Conditions -- Commercial Items and 52-212-5 entitled Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items. The following factors will be used to evaluate offers: (A) Price, (B) Past Performance and (C) Technical capability of the item(s) offered to meet the Government requirement. Technical and Past Performance when combined are approximately equal to Price. Past Performance/Experience shall include a minimum of three (3) references for contracts for similar products/services, which are no more than three (3) years old. All references shall include current information, which will allow for verification of the data provided (contract number, agency or company name, point of contact, current telephone number and fax number). Evaluation of Past Performance will be based on information obtained from the references provided by the Offeror, as well as any other information the Government may have obtained from other sources. Proposal shall include pricing for the IEEE Electronic Library product/service for a 12-month period and four (4) 12-month option periods. The Government will evaluate offers for award purposes by adding the total price for all option(s) to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options will not obligate the Government to exercise the option(s). A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contractwithout further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. A firm fixed price commercial item contract will be awarded. Any offeror(s) submitting a proposal pursuant to this announcement shall reference Solicitation No. 52-PAPT-901010. All interested parties shall submit a proposal for consideration to be delivered to the Patent and Trademark Office, Office of Procurement, 2011 Crystal Park 1, Suite 810, Arlington, VA 22202, Attention: Ms. Dora Sanders, no later than 3:00 PM (EST) on February 16, 1999.
