All proposals received in response to the combined synopsis solicitation will be considered by the government. A determination by the government not to compete this proposal contract based upon response to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. This combined synopsis solicitation for commercial items is prepared in accordance with the format in FAR subpart 12.6. This announcement constitutes the only solicitation; quotations are being requested and a separate written solicitation will not be issued. Solicitation number N68836-99-T-0121 applies and is issued as a Request for Quotations. This solicitation document and incorporated provisions and clauses are those in effect through the Federal Acquisition Circular 90-37 and Defense Acquisition Circular 91-10. The Standard Industrial Code is 3499 and the business size is 500 employees. This requirement is for a firm fixed price contract for two (2) ea 10FT X 16 FT Sea Guard Marine Fenders manufactured to meet the specifications of American Society for Testing and Material (ASTM) -- Resilient Foam-Filled Marine Fenders. Quoters are required to complete and include copy of the following provisions with their proposal; FAR 52.212-3, Offeror Representative and Certifications for Commercial Items and DFAR 252.255-7000 Buy American Act and Balance of Payment Program Certificate. Clause 52.212-4, Contract Terms and Conditions Commercial Item, applies. Addendum to FAR 52.212-4; Paragrah (b) Warranty -- adds: "Additionally, the government will accept the contractor's commerical warranty".
