This notice is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This procurement is being conducted under the Simplified Acquisition Procedures (SAP). NASA intends to contract with a law firm licensed to practice Trade Mark Law for the monitoring and processing of Foreign Trade Mark activities world wide. The award will be for a 1 Year Basic Agreement, with two option years. Proposal should include pricing for all three years. Background NASA has, on selected trademarks, filed and will continue to file trademark applications in countries other than the United States. According to the trademark laws of these countries, periodically, various fees must be paid and renewal applications and other documentation must be filed to keep the trademarks valid and in force. As such, NASA must file the proper documents and pay the required fees to keep these trademark applications and trademarks from becoming abandoned. NASA is also contemplating an increase in the filing for foreign trademark protection for various other NASA programs, products and services. Statement of Work The contractor shall perform the following functions for NASA: o Monitor trademark activities world-wide (including the United States of America), providing immediate notification to NASA of any trademark problems or concerns, such as the potential trademark infringement of NASA trademarks. o On those marks which NASA selects, file trademark applications, including renewal applications, in one or more of the designated countries listed below; o Prosecute the foreign filed applications; o Prepare amendments, briefs, appeals, requests, oppositions, petitions to cancel, and other documents as needed; o Pay required fees on foreign cases as directed by NASA; o Provide oral estimates to NASA at all stages of the process. The estimates should be provided prior to initiating the work and prosecuting the foreign applications; o Provide copies of all correspondence relating to the administration of the foreign filed applications. Copies should be received by NASA within 30 days of the date prepared, for those initiated by the vendor representing NASA; and within 30 days of the date received for documents prepared by other entities. The designated countries shall include, but are not limited to, the following: Australia Canada The European Community France Germany Japan Mexico Switzerland South Africa South Korea United Kingdom The provisions and clauses in the RFQ are those in effect through FAC 97-13. This procurement is a total small business set-aside. See Note 1. The SIC code and the small business size standard for this procurement are 8111 and $5 Million, respectively. The quoter shall state in their quotation their size status for this procurement. All qualified responsible business sources may submit a quotation which shall be considered by the agency. The DPAS rating for this procurement is DO-C9. Quotations for the items(s) described above are due by 5:00 p.m., December 7, 1999, and may be mailed or faxed to Terri Keane, Code 210.H, Headquarters Procurement, Greenbelt, MD 20771, FAX 301-286-0356, and include, solicitation number, FOB destination to this Center, proposed delivery schedule, discount/payment terms, warranty duration (if applicable), taxpayer identification number (TIN), cage code, identification of any special commercial terms, and be signed by an authorized company representative. Quoters are encouraged to use the Standard Form 1449, Solicitation/Contract/Order for Commercial Items form found at URL: http://procure.arc.nasa.gov/Acq/Forms/Index.html to submit a quotation. Quoters shall provide the information required by FAR 52.212-1. The Representations and Certifications required by FAR 52.2l2-3 may be obtained via the internet at URL: http://ec.msfc.nasa.gov/msfc/pub/reps_certs/sats/ FAR 52.212-4 is applicable. FAR 52.212-5 is applicable and the following identified clauses are incorporated by reference: 52.222-26, 52.222-35, 52.222-36, and 52.222-37. Questions regarding this acquisition must be submitted in writing (by U.S. Mail or Fax 301-286-0356) no later than November 30, 1999. Award will be based upon overall best value to the Government, with consideration given to the factors of proposed technical merits, price and past performance; other critical requirements (i.e., delivery) if so stated in the RFQ will also be considered. Unless otherwise stated in the solicitation, for selection purposes, technical, price and past performance are essentially equal in importance. It is critical that offerors provide adequate detail to allow evaluation of their offer (see FAR 52.212-1(b).
