The Federal Railroad Administration intends to issue a Purchase Order to EMD Engineering under the authority of FAR Parts 12, 13.501(a)- Sole Source Acquisitions, and 6.302-3 -- Content through solicitation number DTFR53-00-Q-00491. This is a combined synopsis solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulations document (FAR) subpart 12.6, as supplemented with additional information included in this notice. This procurement is for Locomotive crash worthiness Tests. The description is as follows: Bare structure of the front portion of EMD SD70M locomotive comprising: (a) an underframe structure of 2ft section from the front end plate, including draft gear pocket, end plate, anticlimber, and a 1" plate at the cut-off end; (b) a short hood including collision posts and internal structures; (c) a cab and subbase structure (without windshield, side sash and doors). The short hood, cab and subbase will be fabricated as one subassembly. The cab does not include the electrical cabinet but the back of it will be closed off with a proper structure to ensure its structural integrity. The underframe and short hood-cab subassemblies will be shipped by truck. The Contractor shall integrate the subassemblies. The trucking company shall provide lifting and welding equipment. This procurement is for Equipment & Operating Practices Division, FRA, Washington DC. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under authority for FAR 13.501(a). Only one responsible source and no other supplies can offer the required EMD Locomotive Front End Test Article to conduct crash worthiness Strength Tests on the Test Article. By virtue of the item being purchased the Electro Motive Division, GM is the only supplier of this test article. No one else can make this design. A sole source justification has been prepared in support of this acquisition. The provision at FAR 52.212-1, Instructions to Offerors, applies to this acquisition to the extent consistent with a sole source acquisition. EMD Engineering shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer. The clause at FAR 52.212-4, Contract terms and conditions-Commercial Items, applies to this acquisition. The clause at FAR 52.212-5 Contract Terms and Conditions Required to Implement Statues or Executive Orders-Commercial Items, applies to this acquisition.
