Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. The solicitation number is EP1726-01 and this solicitation is issued as a Request For Proposals (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-20. The North American Industry Classification System code is 421840 and small business size standard is 500. UNICOR, Federal Prison Industries, Inc., intends to enter into a three-year, firm-fixed-price, indefinite delivery/indefinite quantity supply contract for the following commercial item: Item 00001 Pallet, 48"Lx40"W, 4-way-entry, wood, UNICOR part number PAC1939, guaranteed minimum quantity: 550 each, estimated maximum quantity: 1650 each; Item 00002 Box, Medium, Helmet, 26"Lx21"Wx12"D, type: CR, style: RSC-L, variety: double wall, class: domestic grade 275, in accordance with ASTM-D-5118, UNICOR part number PAC1526, guaranteed minimum quantity: 7700 each, estimated maximum quantity: 23,100 each; Item 00003 Liner, Medium, Helmet, 26"Lx21"Wx12"D, type: CR, style: RSC-L, variety: double wall, class: domestic grade 275, in accordance with ASTM-D-5118, UNICOR part number PAC1527, guaranteed minimum quantity: 7700 each, estimated maximum quantity: 23,100 each; Item 00004 Cushion, Cellulose material, Type: II, Class: B, 24"Wx28"Lx1/4"thick, Maximum roll length 250, embossed, MIL-A-A-1898C, UNICOR part number PKG0103, guaranteed minimum quantity: 180,250 ft, estimated maximum quantity: 540,750 ft. Further description of each line item is provided on the pricing sheet. The government has the option to add future line items within the same scope of items if price is determined to be fair and reasonable. Delivery is required within 30 days from receipt of each delivery order issued. The following FAR clauses and provisions apply to this acquisition: 52.247-34 Destination , delivery shall be FOB destination with a ship to address of UNICOR, Medium Institution FCC Beaumont, 4550 Hebert Rd., Beaumont, TX 77705. The COTR is Rafael Otero, telephone (409) 727-0101 ext. 5306; 52.212-1, Instructions to Offerors -- Commercial; 52.212-2, Evaluation -- Commercial Items, evaluation of offers will be based on 40% price and price related factors and 60% past performance including on-time delivery; 52.212-3, Offeror Representations and Certifications -- Commercial Items -- must be completed and provided with offer; 52.212-4, Contract Terms and Conditions -- Commercial Items; 52.212-5, Contract Terms and Conditions Required to Implement Statues or Executive Orders -- Commercial Items, which includes 52.203-6, Restrictions on Subcontractor Sales to the Government, with Alternate I and 52.232-33, Payment of Electronic Funds Transfer -- Central Contractor Registration; 52.204-6, Contractor Identification Number Data Universal Numbering System (DUNS); 52.216-18 Ordering , orders may be issued under the resulting contract from the date of award through three (3) years thereafter; 52.216-19, Order Limitation applies with (a) minimum order of $6000; (b)(1) max order for a single item in excess of $165,500; (b)(2) any order for a combination in excess of $465,000 each contractor will not be obligated to honor. Contractor will not be obligated to honor a series of orders from the same ordering office, within a 15 day period that together call for quantities exceeding the maximum order limitations. However, the contractor shall honor orders exceeding the maximum order limitations unless the order, or orders, is returned to the ordering office within seven calendar days after issuance with a written statement expressing the contractors intent not to ship; 52.216-22 Indefinite Quantity -- applies until 30 days after contract validity end date; 52.211-16 Variation in Quantity -- with 1 percent increase or 0 percent decrease; and 52.232-18 Availability of Funds. Local clause FPI 1000H1 Economic Price Adjustment applies: Twelve months after contract award date, contract prices for the succeeding twelve-month period may be adjusted in accordance with the change in the Producer Price Index/product code (for item 00001: 2448-162, item 00002: 2653-11903, item 00003: 2671-S, item 00004: 2671-S) from the date of award to the date of adjustment. IT IS THE CONTRACTORS RESPONSIBILITY TO REQUEST THIS ADJUSTMENT. Adjustments may be requested for a period not to exceed 30 days after the eligible adjustment date. Requests that are made after the 30-day limit will not be honored and the contract pricing will not be adjusted. The contractor shall submit any requests for adjustments in writing to the contracting officer. Requests shall include a copy of the relevant index and must be within the allowed time period for adjustment. Any adjustments authorized as a result of the adjustment request will not be retroactive. The date the completed request is received by the contracting officer will be the effective date of any changes in price. The contractor also is required to request downward price adjustments. All downward adjustments will be retroactive to the authorized adjustment date as specified in this clause. If downward price adjustments are not requested and this is later revealed through audits or otherwise, the contractor shall reimburse the Government the amount overcharged plus interest. Interest will be computed at the rate set annually by the Secretary of the Treasury for late contract payments. Interest will accrue from the date the adjustment should have been made. In computing any contract price adjustment, the most recently published index as of the date of award will be compared to the most recently published index as of the date of adjustment. No adjustment shall be made if the referenced change is less than 2%. Total upward adjustment for the contract period, including any option periods, shall not exceed 10%, based on the original or option period contract price; downward adjustments are not limited. Indices are available from the Bureau of Labor Statistics, 600 E Street N.W., Washington, DC 20212, telephone 202-606-7706. In addition, FPI9999.999-9, Business Management Questionnaire must be completed with a minimum of three references of contracts that are of similar size and complexity. OMB Clearance 9000-0136 expires 9/30/01. Vendors shall submit signed and dated offers to UNICOR, Federal Prison Industries, 320 First St., NW, 7 th Flr. MMB, Washington, DC 20534, ATTN: Bid Custodian. If hand carried, sent Federal Express or UPS, send to 400 First St., NW, Washington, DC 20534. Offers should be submitted on the SF1449. Offers along with certifications may be sent by facsimile to (202) 305-7363/7365 to the attention of James D. Sprandel, Contracting Officer. The date and time for receipt of proposals is January 22, 2001 at 2:00 PM Eastern Standard Time. Offer must indicate Solicitation No. EP1726-01, time specified for receipt of offer, name, address and telephone number of offeror, technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation, terms of any expressed warranty, price and any discount terms, remit to address, a completed copy of representations and certifications at FAR 52.212-3, and acknowledgement of all amendments, if any. All offers that fail to furnish required representations and certifications or information or reject the terms and conditions of the solicitation may be excluded from consideration. The Government may make award without discussions; therefore, the offerors initial offer should contain offerors best pricing. Award(s) will be made based on best value to the government. Any amendments hereby issued to this solicitation shall be synopsized in the same manner as this solicitation and must be acknowledged by each offeror. Offeror must hold prices firm for 60 calendar days from the date specified for receipt of offers. Offers or modifications to offers received at the address specified for the receipt of offers after the exact time specified may not be considered.
