Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulations (FAR) 12.6, as supplemented with additional information included in this notice. The solicitation number is R1-16-01-024Q, and is issued as a Request for Quotation. This announcement constitutes the only solicitation that will be issued. The solicitation documents, incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-24. The North American Industry Classification System (NAICS) number is 532120. This is not a small business set-aside. Firm Fixed Price purchase orders will be issued under this Indefinite Quantity, Indefinite Delivery Contract. Multiple awards are anticipated. The minimum number of vehicles to be ordered is a TOTAL of 66 vehicles for all awards combined. Other Forest Service Offices will be allowed to order from this contract. Delivery is FOB Destination. Pricing is to include delivery and pick-up. Vehicles leased under this agreement shall be in good mechanical condition and meet the requirements below. Vehicles shall be no older than three calendar years and shall have no more than 50,000 miles on the odometer when accepted. Vehicles submitted under this contract shall be completely serviced and be in good mechanical condition at the time of delivery. A Forest Service Representative will inspect all vehicles delivered under this contract. Deviations from the following shall be noted: 1) All tires shall match and have no less than 50% tire tread remaining upon acceptance. 2) Spare tire shall be mounted in a spare tire rack or carrier. 3) The vehicle must have a functional Original Equipment Manufacturers (O.E.M.) jack, jack tool and lug wrench and all shall be mounted in the O.E.M. factory installed carrier. 4) The vehicle shall have a correctly functioning AM/FM radio. 5) Vehicles shall have O.E.M. standard seat belts for all persons the vehicle is designed to carry. 6) Vehicle odometers and speedometers shall register mileage accurately. 7) Vehicles shall not be delivered with license plates as Government license plates will be installed. 8) Windshield glass shall be fee of cracks and sand damage. Rock chips are acceptable provided they have been repaired and are not visible. 9) Mirror glass shall not be cracked or show spotting and shall be securely fastened in place. Mirror brackets and lens holders shall be correctly and securely mounted to the vehicle. Electrically controlled mirrors, where installed shall operate correctly. A Forest Service representative shall inspect all vehicles returned at the end of the lease period. The Contractor shall be given a copy of each pre/post-inspection. The Government will take responsibility for routine maintenance such as tire repairs, vehicle fluid replacement, vehicle oil and filter replacements, vehicle lube jobs, and vehicle cleaning. The Contractor shall be responsible for repairs due to breakdown or worn parts to include, but not limited to, ordinary wear and tear tire replacement, engine, transmission and drive train repairs, brakes, electrical and suspension work. The Government shall notify the Contractor when a vehicle is taken out of service for mechanical repairs. The Contractor shall provide the Forest Service a like replacement vehicle for any vehicle whose repair time exceeds four days. The Government shall not pay rent for days the vehicle is undergoing mechanical repair and is unavailable for use. See terms and conditions, FAR 52.208-4 Vehicle Lease Payments. 52.208-5- Condition of Leased Vehicles; 52.208-6 Marking of Leased Vehicles; and 52.208-7 Tagging of Leased Vehicles. Return pick-up location for each vehicle will be the same as the delivery. Vehicles provided shall operate on unleaded gasoline. Loss, Damage, Or Destruction For equipment furnished without operator, the Government will assume liability for the loss, damage, or destruction of equipment furnished under this contract, provided that no reimbursement will be made for loss, damage, or destruction when due to (1) ordinary wear and tear, (2) mechanical failure, or (3) the fault or negligence of the Contractor or his agents. All claims arising under this clause will be submitted to the Contracting Officer. These vehicles will be used on dirt and gravel roads that are dusty, narrow, brushy, and steep. Under these conditions, normal wear and tear shall include, but not be limited to, scratches to paint (no dents), paint chips, paint wear, increased tire wear and chipped windshields. If a vehicle(s) incurs damage and the Contractor considers the damage to be other than "normal wear and tear", the Contractor may submit specific written claims for damage in accordance with the disputes provisions of the contract. The Contractor has the burden of proving that any damage claimed is other than normal wear and tear, that such damage is solely attributable to the fault of the Government, and that the amount claimed represents the actual damage (cost) incurred. Claims against the Government for damage to rental vehicles must be submitted and fully supported. Claims must be submitted in writing and must be substantiated by proper pre-use and release inspections. Unsubstantiated claims will be denied. A repair estimate must be furnished in support of the amount claimed. If the amount is over $250, two repair estimates from different repair shops must be approved. Photos, accident reports, witness statements, or other supporting evidence shall be furnished, if reasonably available. All vehicles to include a minimum of 2000 free miles per month, per vehicle. Include an excess mileage fee, if applicable. Drivers will be 18 years of age or older with a valid driver's license. The following FAR provisions and clauses apply to this acquisition; FAR 52.212-1 Instructions to Offerors -- Commercial Items; FAR 52.212-3 Offeror Representations and Certifications -- Commercial Items (OFFERORS SHALL SUBMIT COMPLETED REPRESENTATIONS AND CERTIFICATIONS ALONG WITH THEIR WRITTEN PROPOSAL OR OFFERS WILL BE REJECTED); FAR 52.212-4 -Contract Terms and Conditions -- Commercial Items; FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items with the additional FAR clauses stated at the following paragraphs within 52.212-5 applying: (a) (b) (11) (12) (13) (14) (15) (22) (24) (d) & (e).
