- NASA intends to contract a patent firm for the tracking and maintenance of NASA's foreign patent applications. The award will be for 1-year basic agreement, with one option year. Your proposal should include pricing for both years. This procurement is being conducted under the Simplified Acquisition Procedures (SAP). Background NASA has, on selected inventions, filed patent applications in countries other than United States. According to the patent laws of these countries maintenance fee must be periodically paid to keep the patent applications pending and to keep the patents that issue from them in force. As such, the contractor, on NASA's behalf, must pay these fees to keep its patent applications and patents from becoming abandoned. Statement of Work: The contractor will create and maintain a docket of NASA's foreign patent applications and patents. The contractor is also prepared to accomplish the same task for corresponding U.S. patents. The docket will contain all items listed in the Statement of Work to include: NASA Case Number, Invention Title, U.S. Filing Date, U.S. Serial No., U.S. Issue Date Patent No., Attorney, Assignee, Inventors, Countries, Foreign Filing Date, Priority Date, Foreign Serial No., Publication Date, Type Case, Status of Case, Foreign Issue Date, Foreign Patent No., Expiration Date, Annuity Due Date, Annuity Paid Through, Annuity/Tax Year Number, Working Date, Abandonment Date, Name and Address of Foreign Agent, Name of Licensee, Remarks. The contractor will validate all data supplied by NASA against publicly available patent databases, and it will advise NASA of any discrepancies or omissions. On a quarterly basis, the contractor shall notify NASA of all patent cases coming due for maintenance payment with an estimated cost to renew expressed in U.S. Dollars. The estimated cost is quoted for each renewal and is subject to variations in exchange rates and official fees. The contractor will provide NASA with reminder reports of any annuities that are due and payable in advance of the payment due date. The contractor, utilizing an established network of foreign patent agents, or direct context with foreign patent offices, will make the annuity payments to the foreign patent offices on NASA's behalf. The contractor will provide to NASA payment receipts from foreign patent offices. Additionally, the contractor will determine if payments were actually received by the foreign patent offices if receipts were not received. The contractor will provide NASA with reports generated from NASA's databases, maintained by the contractor, as required. This procurement is being conducted under the Simplified Acquisition Procedures (SAP). The Government intends to acquire a commercial item using FAR PART 12. Oral communications are not acceptable in response to this notice. The offeror shall describe the company's experience, no more than three activities, with contracts and organizations of similiar size and scope, and complexity to this RFQ. All qualified responsible sources may submit a quote which shall be considered by the agency. Selection will be made on a best value basis considering price, quality, and past performance. An ombudsman has been appointed -- See NASA Specific Note "B". The solicitation and any documents related to this procurement will be available over the Internet. These documents will be in Microsoft Office 97 format and will reside on a World Wide Web (WWW) server, which may be accessed using a WWW browser application.
