- In August 1998 the U.S. Patent and Trademark Office (USPTO) competitively awarded through the GSA FSS a Blanket Purchase Agreement (BPA) to Software Performance Systems (SPS) for software development and maintenance support using the Cool:Gen development toolset. BPA 45PTO816000 will expire in September 2001; therefore, the USPTO intends to negotiate on a sole source basis with Software Performance Systems, Inc. for the completion of Cool:Gen development and maintenance activities begun under BPA 45PTO816000. Work to be tasked under the sole source will be for development, deployment, and post development support of projects begun under BPA 45PTO816000, maintenance of projects developed under BPA 45PTO816000, and transition of development and maintenance activities to other contracts. The period of performance will be for eleven (11) months with an expected start date of October 1, 2001. The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under authority FAR 6.302. SPS is the only source with the corporate knowledge and expertise necessary to complete the development, deployment and maintenance of mission-critical projects, as well as provide the necessary expertise for an effective and orderly transition. Failure to complete the projects issued under BPA 45PTO816000 would adversely impact the USPTO's ability to deploy and maintain mission-critical systems. This is NOT a request for proposals, nor will one be made available. However, concerns that respond must furnish detailed information describing capabilities to deliver the above services to: U.S. Patent and Trademark Office, Office of Procurement, Box 17, Washington, DC. 20231.
