Description

The following FAR clauses shall apply:52.212-1, Instructions to Offerors-Commercial Items;52.212-3, Offeror Representations and Certifications-Commercial Items (Offeror shall include a complete copy of this provision with their proposal); 52.212-4, Contract Terms and Conditions-Commercial Items; and 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items with the additional FAR clauses stated at the following paragraphs within 52.212-5(b)(1)(3)(6)(7)(11)(12)(13)(14)(15)(16)(21)(25). The clauses and certifications referenced above may be obtained from the following website:http://www.arnet.gov. Offers are due Setpember 24, 2001, by 12:p.m. (EST). 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders- Commercial Items. As prescribed in 12.301(b)(4), insert the following clause: Contract Terms And Conditions Required To Implement Statutes Or Executive Orders-Commercial Items (May 2001)(a) The Contractor shall comply with the following FAR clauses, which are incorporated in this contract by reference, to implement provisions of law or executive orders applicable to acquisitions of commercial items: (1) 52.222-3, Convict Labor (E.O. 11755). (2) 52.233-3, Protest after Award (31 U.S.C. 3553).
